Terms of service.

1. Definitions

1.1 “Company” refers to Portable Projects, specialising in construction services.

1.2 “Client” refers to the individual, company, or entity commissioning the Company’s services.

1.3 “Contract” refers to the agreement between the Company and the Client, including these Terms and Conditions.

1.4 “Quotation Fee” refers to the fee charged for preparing a quotation for the Client’s project.

1.5 “CDM Fee” refers to the fee charged for compliance with the Construction (Design and Management) Regulations 2015.

2. Scope of Services

2.1 The Company agrees to provide construction services as outlined in the agreed contract and any accompanying documents.

3. Quotation Fee

3.1 The Company may charge a Quotation Fee, payable upon request of a detailed quotation.

3.2 If the Client proceeds with the project, the Quotation Fee will be deducted from the total contract value.

3.3 If the Client chooses not to proceed, the Quotation Fee is non-refundable.

4. Payments

4.1 The Client agrees to pay an upfront payment of 50% of the agreed contract value before work commences.

4.2 The remaining balance is payable upon agreed milestones or project completion, as specified in the contract.

4.3 A CDM Fee equal to 6% of the total contract value will be charged to ensure compliance with all relevant regulations.

4.4 Payment terms and schedules will be detailed in the contract. Late payments may incur additional charges as outlined in the contract.

5. Warranty

5.1 The Company offers a warranty of three (3) years on all structures installed by the Company.

5.2 The warranty covers defects in materials and workmanship under normal use and conditions.

5.3 The warranty does not cover damage caused by misuse, unauthorized modifications, natural disasters, or regular wear and tear.

5.4 Any claims under the warranty must be submitted in writing, and the Company reserves the right to inspect and validate the claim.

6. Project Timelines

6.1 The Company will make every effort to complete the project within the agreed timeline.

6.2 Delays caused by unforeseen circumstances, including weather, supply chain issues, or changes requested by the Client, may affect timelines and the Client accepts that any changes to agreed scope will incur additional time.

7. Cancellation and Termination

7.1 The Client may cancel the project by providing written notice.

7.2 If cancellation occurs after work has commenced, the Client agrees to pay for work completed up to the cancellation date, including the 50% upfront payment.

8. Liability

8.1 The Company will not be liable for any indirect or consequential losses resulting from the project.

8.2 The Company’s total liability under the contract will not exceed the value of the project.

9. Compliance

9.1 The Company will comply with all relevant health, safety, and building regulations, including CDM regulations.

10. Dispute Resolution

10.1 Any disputes arising from the contract will be resolved through mediation or arbitration as agreed upon by both parties.

11. Governing Law

11.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of the UK.

12. Acceptance

12.1 By signing the contract or paying the Quotation Fee, the Client agrees to these Terms and Conditions.
